The following TERMS, CONDITIONS, WAIVER and RELEASE apply to Bootcamp Republic’s RETAIL program and/or ONSITE corporate program and/or OFFSITE corporate program:

I am an adult. (18 years or older)

I agree and represent that I understand the nature of Bootcamp Republic’s programs; both fitness and/or nutrition (herein after the “Activity”) and that I am in good health, and in proper physical condition to participate in such Activity. I recognize that exercise is not without varying degrees of risk to the musculosketal and/or cardio-respiratory system. I hereby certify [Female (that I am not pregnant and there is no risk of me being pregnant) and/or] that I know of no medical problems that would increase my risk of illness and injury as a result of participation in a Bootcamp activity designed by Bootcamp Republic. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the Activity.

I fully understand and have been informed that there exists the possibility of adverse body changes during the Bootcamp fitness program. I have been informed that these changes may include abnormal blood pressure, fainting, disorder of heart rhythm, stroke and very rare instances of heart attack or even death.

I fully understand and have been informed that Bootcamp Republic works in conjunction with Nutrition Counselors NOT physicians. As such, Nutrition Counselors do not diagnose or treat disease. I realize I should consult a physician before undergoing any dietary or food supplement changes. Any recommendations I follow for changes in diet, including, but not limited to, the use of food supplements are entirely my responsibility. I fully accept, all foreseeable and/or not readily foreseeable risk, all responsibility for losses, costs, and damages I may incur as a result of my participation in any Activity.

I hereby agree to waive, release, remise, discharge, and covenant not to sue Bootcamp Republic, and its parent company, subsidiaries, agents, officers, administrators, directors, independent contractors, contractors, partners, principals, employee, joint ventures, volunteers, or others participating in the programs, organizers, any sponsors, advertisers, and if applicable, employers, owners and lessors of premises, on which the Activity takes place, (each considered one of the Releasees herein) from all liability claims, demands, losses or damages on my account caused or allege to be caused in whole or in part by the Releasees (including negligence) or otherwise; in any kind resulting from participation in a Bootcamp program offered by Bootcamp Republic; such as but not limited to personal injury and/or lost, stolen or damaged personal property I bring to any Bootcamp Republic program. I further agree that if, despite this release and waiver of liability, assumption of risk, and indemnity agreement, I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify save and hold harmless each of the Releasees, from any litigation’s expenses, attorney fees, loss, liability, damage, or cost which any may incur as a result of such claim. I also agree that this is a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this Terms, Conditions, Waver and Release is held to be invalid, the balance, notwithstanding, shall continue in full force and effect.

I hereby agree that by participating in any Bootcamp Republic program, that any dispute or claim arising out of or connected with this agreement or the performance, breach or termination thereof, shall be finally settled by arbitration in New York, New York under the rules of arbitration of the American Arbitration Association or applicable New York law regarding mandatory arbitration. I also agree that Bootcamp Republic’s liability for any losses or other damages related to this agreement shall be limited to my demonstrable, direct damages and will not exceed fifteen percent (15%) of the of the revenues paid by me for any of Bootcamp Republic’s programs.

I hereby agree that certain information about me which is collected during registration is subject to the Bootcamp Republic Privacy Policy. I can access and modify the information I provide and choose not to receive certain communications by contacting Bootcamp Republic. I have read and agree to the Bootcamp Republic Privacy Policy at http://www.bootcamprepublic.com/privacy.asp which is herein incorporated and made a part hereof as though set forth in length. I understand that through my use of Bootcamp Republic’s services that I consent to the collection and use (as set forth in the applicable privacy policy) of my information. If I object to my information being transferred or used in this way I will not use Bootcamp Republic services.

I freely and voluntarily, ACCEPT/AGREE, TO THE ABOVE TERMS AND CONDITIONS to participate in Activity, fitness programs (“Bootcamp”) and/or nutrition programs, given by Bootcamp Republic.
